PLEASE READ WITH CARE : Romantik Safaris and Travel Ltd, Registered in Kenya registration no. C95642 hereinafter called (RST) accept booking subject to the client agreeing to the conditions set out below: -

1) ACCEPTANCE OF BOOKING a booking is only accepted when RST has received 40% deposit, complete booking form and have issued a confirmed advice. RST reserve the right to alter the deposit percentage depending on booking requirements

2) FINAL PAYMENT is due to RST 60 days before any departure and RST reserves the right to treat any arrangement as being cancelled by the client if such payment is not received.

3) CANCELLATION OF A BOOKING RST has no intention of making substantial alterations or of cancellation any arrangement booked for a client, but in the event that prior to departure this deemed necessary by RST taking into account the interest of the clients booked then RST will promptly send out notification of such changes of cancellation.

CANCELLATION BY THE COMPANY

a) The company may cancel suspend, alter or withdraw the booking at any time prior to the departure date when that payment of the whole of the fare is due in which case the company ‘s liability will be limited to refunding all monies received from the client.

b) At any time the company may suspend, cancel, alter or withdraw the booking in the event of a "force de majeure" in which case the client will be refunded monies received by the company less the dedications for reasonable expenses incurred by the company.

CANCELLATION BY THE CLIENT

Notification of cancellation or request for amendments to bookings must be given in writing by letter, Fax or e-mail to RST at the address shown. If RST agrees to alter a booking after the booking has been confirmed in writing by RST, a refund will be effected as follows;

•  Earlier than 31 days before departure full deposit less correspondence fees.

•  Between 30 and 15 days before departure, 35% of the tour cost

•  Between 14 and 5 days before departure, 75% of tour cost

•  Between 5 days and the day of departure (no show), 100% of the tour cost

4) PRICES: Before accepting a booking RST reserves the right to alter published prices. After confirming a booking RST will only alter prices to take into account factors beyond it's control such as exchange rate variation, surcharge or transportation or accommodation rate.

5) TRAVEL DOCUMENTS; It is responsibility of the client to ensure that they are in possession of valid travel documents including passports, visas, health certificates etc. RST cannot accept any liability for incorrect documentation.

6) INSURANCE: Clients are advised to obtain personal travel insurance and are urged to ensure that this is adequate for the full duration of the arrangements and is also sufficient to cover the client's personal responsibilities particularly in respect of any dependants. The client's attention is drawn to the insurance cover Available from the company to promote against such risks. Refunds will be as the above provisions where the company receives notice of cancellation of a booking.

7) DISPUTES: This arrangement between the client and RST is made subject to all laws of Kenya and shall be interpreted and construed in a Kenya court of law.

8) The company‘s responsibilities and conditions of carriage.

 a) General

  • The company does not accept and hereby excludes all liabilities for the acts or omissions whether negligent or otherwise of airlines, coach operators, hoteliers or any person providing goods or services in connection with any booking, unless such person is either employed by it or acting within a scope of his/her employment or its agent under it's control.
  • The company accepts no liability for any loss or damage caused by events beyond its control
  • Where properties are not features within the company ‘s brochure, company will not be liable for any claims that such properties booked by the client‘s express request do not satisfy clients expectations.

b) Third party conditions

-       The company is not itself a provider of accommodation, air, and or ground services in connection with the client ‘s holiday.

-         All booking are accepted and all arrangements are made by the company subject to A) any and all conditions imposed from time to time by airlines and sea, rail and road carrier, car rental companies, providers of accommodation, catering and other services or other services connected with a booking and such conditions will apply to the client as if they were in cooperated into these conditions and (B) any law direction or order imposed from time to time by any competent authority.

-         Some of the third party condition are referred to above seeks to exclude or limit the liability of the third party concerned: for instance the liability for airlines for personal injury (including death) or loss or damage to property and baggage is usually limited in conditions contained within the airlines ticket and condition of carriage (and or by operation of law)

9) COMPLAINT/REFUND; If the client has complaint /refund query about any aspect of his or her holiday it should be reported immediately to the company's local representative in the resort who will do whatever he/she can do during holiday. If the problem is not resolved to the client's satisfaction, the client in writing should make any further complaint/refund query to customer affairs and service audit, Romantik Safaris and Travel Ltd, not later than 30 days following completion of the holiday. Following which no complaints may be brought against the company. Credit card charges are subject to additional 5% handling fees. Credit card 5% handling fee is non refundable. There is no refund for any Fed Ex , Airmail or bank transfer charges.

10) The information contained herein is accurate in time of publication. However in the event of any difference between the products feature in Romantik Safaris holidays brochure and those contained in this price guide, kindly contact your Romantik Safaris holiday representative for further details.
